Article VI. ARNDT ANNEXATION  


(1)

Territory annexed. In accordance with an action taken at a regular meeting on the second day of February, 1971, the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit:

That part of the NE one-fourth of the NW one-fourth of section number 35, town 4 north of range 13 east, being the Township of Milton, Rock County, Wisconsin, bounded and described as follows:

Beginning at the northwest corner of the NE one-fourth of the NW one-fourth of said section 35; thence south 87 degrees 56 minutes east along the section line 374.89 feet; thence south along a line parallel with the quarter quarter line 905.26 feet to the center of the Johnstown Road; thence north 41 degrees 52 minutes west along the centerline of the said Johnstown Road 573.73 feet to its intersection with the quarter quarter line; thence north along the said quarter quarter line 491.5 feet to the place of beginning, containing six acres, more or less; subject to a grant of easement previously given to the Wisconsin Natural Gas Co.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designated to be part of the industrial district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the second ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
