(1) Territory annexed. In accordance with Wis. Stats. § 66.021 and the petition for direct annexation filed with the city clerk on the fourth day of April 1989, signed by the owner of all of the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit: Part of the NW. one-fourth of the NE. one-fourth and part of the NE. one-fourth of the NW. one-fourth of section 33, T.4N., R.13E. of the fourth P.M., Milton Township, Rock County, Wisconsin, described as follows: Commencing at the north one-fourth corner of said section 33; thence N. 89 degrees 58 minutes 20 seconds W. along the north line of the NW. one-fourth of said section, 850.00 feet to the NW. corner of a Certified Survey Map as recorded in Volume 11, Pages 388 and 389, also being at the place of beginning for the land to be herein described; thence S. 0 degrees 01 minutes 40 seconds W. 550.00 feet to the SW. corner of said Certified Survey Map; thence S. 89 degrees 58 minutes 20 seconds E. 886.59 feet to the SE. corner of said Certified Survey Map; thence S. 27 degrees 57 minutes 30 seconds W. along the northwesterly R.O.W. (right-of-way) line of the C.M. St. P. & P. RR. Property, 497.22 feet; thence N. 66 degrees 33 minutes W. 514.69 feet to a point of curve; thence northwesterly along a curve convexed southwesterly, 333.47 feet, having a radius of 434.35 feet and a chord bearing N. 44 degrees 33 minutes 20 seconds W. 325.34 feet to a point of tangency; thence N. 22 degrees 33 minutes 40 seconds W. 329.80 feet to a point of curve; thence northwesterly, along a curve convexed southwesterly, 256.06 feet, having a radius of 749.96 feet and a chord bearing N. 12 degrees 46 minutes 47 seconds W. 254.82 feet to said north line; thence S. 89 degrees 58 minutes 20 seconds E. along said north line, 229.98 feet to the place of beginning. (2) Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton. (3) Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be part of the A-2 district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton. (4) Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the sixth ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards. (5) Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or application of this ordinance which can be given effect without the invalid or unconstitutional provision or application. (6) Effective date. This ordinance shall take effect upon passage and publication as provided by law. |
