Article XVIII. EXXON ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021(12) and the petition for direct annexation filed with the city clerk of the City of Milton on the 20th day of November, 1990, signed by all of the owners of the land in this territory, the following described territory in the Town of Milton, Rock County, Wisconsin, shall be annexed to the City of Milton, to-wit:

All that part of the west one-half of the S.W. one-fourth and of the west one-half of the N.W. one-fourth of section 28, T.4 N., R. 13 E., of the fourth P.M., Town of Milton, Rock County, Wisconsin, described as follows:

Beginning at a point in the east and west centerline of section 28, aforesaid, 1316.50 feet south 87 degrees 28 minutes east of the west quarter, corner of said section; thence south 0 degrees 03 minutes 00 seconds west 1331.04 feet; thence north 87 degrees 32 minutes 13 seconds west 208.68 feet; thence north 0 degrees 03 minutes east 1070.00 feet; thence north 36 degrees 00 minutes 07 seconds west 687.09 feet to the south right-of-way of the Wisconsin & Calumet Railroad; thence south 76 degrees 33 minutes 15 seconds east along said right-of-way line 630.00 feet to the west line of the east one-half of the S.W. one-fourth of section 28, aforesaid; thence south 0 degrees 03 minutes west along said line 157.29 feet to the place of beginning. Containing 9.3529 acres, more or less.

Effective date of annexation. From and after the date of this ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons currently residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be zoned M-1 industrial for zoning purposes and shall be designated as such on the City of Milton map and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the sixth ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or application of this ordinance which can be given effect with the invalid or unconstitutional provision or application.

(6)

Effective date of annexation. This ordinance shall take effect upon its passage and publication as provided by law.
