Article I. LARSON ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021 and the petition for direct annexation filed with the city clerk-treasurer on the 17th day of June, 1969, signed by a majority of the electors residing in the territory and the owners of at least one-half of the land in area in the territory, the following described territory in the Town of Milton, Rock County Wisconsin, to-wit:

Commencing at the southwest corner of said section, thence S. 87 degrees 29 minutes 45 seconds E. on a true bearing along the south line of said section, 803.85 feet to an iron pipe monument set at the intersection of said south line with the centerline of Hilltop Drive, also being the west line of O.L.'s 152, 151 and 150; thence N. 0 degrees 42 minutes 15 seconds W. along said centerline, 298.37 feet to an iron pipe monument at the intersection of said centerline with the north line of Orchard Row as such is extended westerly from Green Hill Subdivision; thence N. 89 degrees 10 minutes 30 seconds E. along said north line, 180.00 feet to an iron pipe monument set at the place of beginning for the land to be herein described; thence N. 0 degrees 42 minutes 15 seconds W., parallel with said centerline, 415.17 feet to an iron pipe monument; thence S. 87 degrees 29 minutes 45 seconds E., parallel with said south line of section 27, 328.58 feet to an iron pipe monument set on the east line of said O.L. 152; thence S. 0 degrees 42 minutes 15 seconds E., along said east line, also being parallel with said centerline 396.12 feet to an iron pipe monument set on said north line; thence S. 89 degrees 10 minutes 30 seconds W. along said north line, 328.07 feet to the place of beginning. Containing 3.0 acres.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designated to be part of the residence district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the second ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
