Article II. SHADEL - NATTER - THOMPSON ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021 and the petition for direct annexation filed with the city clerk on the 29th day of October, 1969, signed by a majority of the electors residing in the territory and the owners of at least one-half of the land in area in the territory, the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit:

All that part of Out Lot 16 Assessor's Plat in the Township of Milton, Rock County, Wisconsin, described as follows, to-wit:

Part of the W one-half of the SW one-fourth of section 27 and part of the SE one-fourth of section 28, in township 4 north, range 13 east described as follows, viz:

Beginning in the center of the highway running from Chicago and Madison (Old Territorial) Road south to the Sugar River Road and 32 rods north of the section line; thence west 15¾ rods; thence south 32 rods to the section line; thence west on the section lines of section 27 and 28 to the center of the highway running from Janesville to Ft. Atkinson; thence northerly in center of said highway to the south line of the Monroe branch of C.M.St.P. R.R. running from Milton to Janesville, thence easterly on said south line of said railroad to the west line of section 27; thence south on said section line 7.29 chains thence east 12 125/1000 chains to the center of highway; thence south in center of highway to place of beginning, containing 68 33/100 acres more or less.

Excepting therefrom land conveyed by executor's deed from Nathan Earl Traxler and Woodrow Wilson Traxler, executors of the estate of Samuel J. Traxler, deceased, to Joint Common School District No. 1 of the Villages of Milton and Milton Junction, and Towns of Fulton, Harmony, Janesville, Johnstown, Lima and Milton, County of Rock, and Town of Koshkonong, County of Jefferson, State of Wisconsin, dated September 27, 1963, recorded October 9, 1963 in the office of the Register of Deeds for Rock County, Wisconsin, in Vol. 100 of Records, Page 235, as Doc. No. 665511, conveying the following real estate to-wit:

That part of the SW one-fourth of the SW one-fourth of section 27, and that part of the east one-half of the SE one-fourth of section 28, also known as part of Out Lot 16 of the Assessor's Plat, in town 4 north, range 13 east of the Fourth Principal Meridian, Township of Milton, Rock County, Wisconsin, described as follows:

Beginning at an iron pipe at the southwest corner of said section 27, and at the southeast corner of said section 28; thence N. 87 degrees 21 minutes W. along the south line of said section 28, 489.72 feet to an iron pin; thence north, parallel with the east line of said section 28, 1544.22 feet, to an iron pipe on the southerly right-of-way line of the Chicago, Milwaukee & St. Paul Railroad; thence northeasterly along a curve on said southerly right-of-way of said railroad, having an arc of 508.54 feet a control angle of 8 degrees 33 minutes 26 seconds, a radius of 3404.87 feet, and a chord that bears N. 74 degrees 20 minutes 30 seconds E., 508.05 feet to an iron pipe: thence south along the east line of said section 28 and the west line of said section 27, 481.14 feet to an iron pin over an existing limestone; thence S. 86 degrees 37 minutes E. parallel with the south line of said section 27, 806.63 feet to an iron pin on the centerline of Hilltop Drive; thence S. 0 degrees 08 minutes 40 seconds W. along the centerline of Hill Top Drive, 991.70 feet to an iron pin; thence N. 86 degrees 37 minutes W. parallel with the south line of said section 27, 165.00 feet to an iron pin; thence S. O degrees 08 minutes 40 seconds W. parallel with the centerline of Hill Top Drive 281.00 feet to an iron pin; thence N. 86 degrees 37 minutes W. along the south line of said section 27, 638.55 feet to the place of beginning. Containing 40.00 acres of land. 21.6869 acres being in section 27, and 18.3131 acres in section 28.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designated to be part of the residence district of the City of Milton for zoning purposes except the following described property containing approximately eight acres which will be part of the business district to-wit:

Commencing at the intersection of S. John Paul Rd. and west High St.; thence easterly and along the center of W. High St. 690 feet to a point; thence northerly and perpendicular to W. High St. a distance of 570 feet to a point; thence westerly and parallel with W. High St. and the southerly boundary of this description to the center of S. John Paul Road; thence southeasterly and along the center of S. John Paul Road to the point of beginning of this description.

and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the first ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

(5)

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or application of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
