(1) Territory annexed. In accordance with an action taken at a regular meeting on the 16th day of February, 1971, the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit: Part of OutLot 150 and OutLot 151 Assessor's Plat of Milton Township including Milton Junction, being in the SW one-fourth of section 27, T. 4 N., R. 13 E. of the fourth P.M., Milton Township, Rock County, Wisconsin and described as follows: Commencing at the southwest corner of said section; thence S. 87 degrees 29 minutes 45 seconds E. on a true bearing along the south line of said section, 803.85 feet to an iron pipe monument set at the intersection of said south line with the centerline of Hilltop Drive, also being the west line of O.L.'s 152, 151,and 150; thence N. 0 degrees 42 minutes 15 seconds W. along said centerline 856.02 feet to an iron pipe monument set at the southwest corner of said O.L. 151, thence continuing N. 0 degrees 42 minutes 15 seconds W. along said centerline, 85.50 feet to an iron pipe monument set at the northwest corner of said O.L. 151; thence S. 87 degrees 29 minutes 45 seconds E. along the north line of said O.L. 151, also being parallel with said south line of section 27, 240.00 feet to an iron pipe monument; also being the place of beginning for the land to be herein described; thence N. 0 degrees 42 minutes 15 seconds W., parallel with said centerline, 85.50 feet to an iron pipe monument; thence S. 87 degrees 29 minutes 45 seconds E., parallel with said north line, 268.86 feet to the east line of said O.L. 150; thence S. 0 degrees 42 minutes 15 seconds E. along the east line of said O.L.'s 150 and 151, also being parallel with said centerline, 171.00 feet to an iron pipe monument set at the southeast corner of said O.L. 151; thence N. 87 degrees 29 minutes 45 seconds W. along the south line of said O.L. 151, also being parallel with said south line of section 27, 268.86 feet to an iron pipe monument; thence N. 0 degrees 42 minutes 15 seconds W. 85.50 feet to the place of beginning. Commencing at the southeasterly corner of Out Lot 151, Assessor's Plat of Milton Township, including Milton Junction, being in the southwest quarter (SW one-fourth) of section 27, town 4, north, range 13 east of the fourth P.M., Milton Township, Rock County, Wisconsin; thence north 171 feet to an iron pipe; thence east 3.62 feet to a point; thence south 171 feet to a point; thence westerly 4.15 feet to the point of beginning of this description (the intention of this deed is to disclaim any interest in the property conveyed to the above grantees and lying easterly of the property conveyed to them under warranty deed recorded at the office of the Register of Deeds for Rock County, Wisconsin, on October 29th, 1970, in Volume 372 of Records, Page 186 as Document No. 760643 and more fully outlined on the plat of survey prepared by Richard L. Thom on the 11th day of June, 1969 at Janesville, Wisconsin). Part of OutLot 152, Assessor's Plat of Milton Township including Milton Junction, being in the SW one-fourth of section 27, T. 4. N., R. 13 E. of the fourth P.M., Milton Township, Rock County, Wisconsin. Commencing at the SW corner of said section; thence S. 87 degrees 29 minutes 45 seconds E. on a true bearing along the south line of said section 803.85 feet to an iron pipe monument set at the intersection of said south line with the centerline of Hilltop Drive, also being the west line of Out Lot 152; thence north 0 degrees 42 minutes 15 seconds W. along said centerline 856.02 feet to an iron pipe monument set at the NW corner of said OutLot 152; thence south 87 degrees 29 minutes 45 seconds E. along the north line of said OutLot 152, also being parallel with said south line of section 27, 240 feet to an iron pipe monument; said iron pipe monument being the place of beginning for the land to be herein described and conveyed; thence S. 87 degrees 29 minutes 45 seconds E., 273.01 feet to the E. line of said OutLot 152; thence south 0 degrees 42 minutes 15 seconds E. along the E. line of said OutLot 152, also being parallel with said centerline, 132 feet to a point; thence N 87 degrees 29 minutes 45 seconds W. and parallel with the N. line of OutLot 152 and parallel with the S. line of section 27, 273.41 feet to an iron pipe monument; thence N. 0 degrees 42 minutes 15 seconds W. 132 feet to the place of beginning. (2) Effect of annexation. From and after date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton. (3) Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designated to be part of the residential district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classification and zoning in the City of Milton. (4) Ward designation. The territory described in section (1) of this ordinance is hereby made a part of the second ward of the City of Milton subject to the ordinances rules and regulations of the city governing wards. (5) Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application. (6) Effective date. This ordinance shall take effect upon passage and publication as provided by law. |
