Article IX. CITY-OWNED PROPERTY ANNEXATION - EAST SIDE HILLTOP DRIVE  


(1)

Territory annexed. In accordance with an action taken at a regular meeting on the 18th day of May, 1971, the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit:

Out Lot number 150 of the Assessor's Plat of a part of the Township of Milton, including Milton Junction, in the W one-half of the SW one-fourth of section 27, town 4 north, range 13 east of the fourth P.M., in the Township of Milton, Rock County, Wisconsin, excepting, however, the two parcels described below:

A strip of land of uniform width off from the south end of said Out Lot number 150, being 85.5 feet from north to south lines and 508.86 feet from east to west lines and containing one acre of land, more or less;

That part of said Out Lot number 150 described as follows: Beginning at an iron pipe monument in the east line of Hilltop Drive, 430.17 feet south of an iron pipe monument at the intersection of said east line with the southerly right-of-way line of the C. M. St. P. & P. Ry. land; thence east at right angles, 113 feet to an iron pipe monument; thence south, at right angles and parallel with the east line of Hilltop Drive, aforesaid, 120 feet to an iron pipe monument; thence west at right angles, 113 feet to an iron pipe monument in the east line of Hilltop Drive, aforesaid; thence north, at right angles and along said east line, 120 feet to the place of beginning. Containing 0.311 of an acre.

The E one-half of Hilltop Drive commencing in the center of Hilltop Drive from a westerly extension of the north line of Orchard Row; thence northerly and along the center of Hilltop Drive to the southerly right-of-way line of the C. M. St. P. & P. Railroad;

(It is the intention in the annexation of the above two properties to include all of Hilltop Drive within the city limits of the City of Milton.)

Effect of annexation. From and after the date of this ordinance the territory described in section (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designated to be part of the business district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in section (1) of this ordinance is hereby made a part of the second ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
