Article X. MILTON TOWN ISLAND ANNEXATION  


(1)

In accordance with Wis. Stats. § 66.021(15), the common council of the City of Milton does hereby exercise its power to annex the following described town island(s) located on Hilltop Drive in the Town of Milton, Rock County, Wisconsin, to-wit:

Assessor's Plat, Milton Township, beginning at the intersection of the N. line of Orchard Row and the E. line of Hilltop Drive, continuing northerly 713 feet, hence easterly 240 feet, hence southerly 303 feet, hence westerly 59.74 feet, hence southerly 415.17 feet to the N. line of Orchard Row, hence westerly 180 feet to point of beginning;

Also, Assessor's Plat, Milton Township, part of O.L. 150 - W. 113 feet of S. 120 feet of N. 550.17 feet, containing approximately 3.6 acres.

Effect of annexation. From and after the date of this ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is to be zoned R-2, single-family residential (high density) and be subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the fifth ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances, is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
