Article XIII. CITY-OWNED PROPERTY ANNEXATION-MUNSON POND AREA  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.025, the following described territory in the Town of Milton, Rock County, Wisconsin, owned by the City of Milton and lying contiguous to the present city boundary:

Lot 1 of Certified Survey Map, recorded in Volume 11, pages 388-389, Card #162 Images 458-459, as Document No. 981825, being part of the NW one-fourth of the NE one-fourth and part of the NE one-fourth of the NW one-fourth of section 33, town 3 north, range 13 east, Town of Milton, Rock County, Wisconsin.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be part of the lowland conservancy overlay district one (C-1) of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the sixth ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
