Article XIV. LUKAS ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021 and the petition for direct annexation filed with the city clerk on the 27th day of May, 1987, signed by the owner of all of the following described territory in the Town of Milton, Rock County, Wisconsin, to-wit:

Lots 1 and 2 and a part of Lot 3, Block 1, Chambers Addition and a part of Outlot 113 Assessors Plat of part of Milton Township including Milton Junction in the NW one-fourth of the NE one-fourth of section 28, T4N, R13E, Town of Milton, Rock County, Wisconsin, to-wit:

Commencing at the N one-fourth corner of said section 28; thence S 00 degrees 46 minutes 21 seconds E, along the N-S one-fourth line of said section 28, 320.33 feet to the point of beginning; thence continue S 00 degrees 46 minutes 21 seconds E, along said N-S one-fourth line, 272.11 feet to the extension of the north line of Holmes Street; thence S 87 degrees 56 minutes 46 seconds E, along said north line and its extension, 156.28 feet; thence N 00 degrees 43 minutes 20 seconds W, 91.99 feet; thence N 04 degrees 59 minutes 16 seconds E, 80.11 feet; thence N 00 degrees 43 minutes 20 seconds W, 100.00 feet; thence N 87 degrees 56 minutes 46 seconds W. 164.50 feet to the point of beginning, containing 1.001 acres.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be part of the R-3 district of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinances" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the eighth ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the other provisions or application of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
