Article XX. LUKAS ANNEXATION-1991  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021(12), the following described territory in the Town of Milton, Rock County, Wisconsin, owned by Henry A. Lukas and lying contiguous to the present city boundary:

Beginning at the northeast corner of said section, and running thence southerly along the east line of said section 14 chains and 57 links; thence north 88 degrees 22 minutes west ten chains and 47 links along the lot owned by O.C. Crandall; and westerly in the same direction, nine chains and 46 links to the east line of P. Grannan's land; thence north along said east line of P. Grannan's land, four chains and 95 links; thence northeasterly along the east line of the Chicago and northwestern Railway, ten chains and 36 links to the north line of said section; and thence easterly along said north line, 16 chains and one link to the place of beginning.

Said parcel of land is now known and described as Out Lot Number 114 of the aforesaid Assessor's Plat to the Township of Milton, in Rock County, Wisconsin.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance shall keep its agricultural zoning designation under the applicable Town of Milton Zoning Ordinance pursuant to section 9.28(3) of the Code of General Ordinances of the City of Milton until such zoning classification is changed pursuant to section 9.14 of the Code of General Ordinances.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the eighth ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
