Article XXI. DONALDSON ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021(12), the following described territory in the Town of Milton, Rock County, Wisconsin, owned by Arthur J. Donaldson and lying contiguous to the present city boundary:

Parcel 1: All that part of the following described premises located north and west of the northwesterly right-of-way line of STH 26:

The southeast quarter (SE one-fourth) of section 34 in township four north, range 13 east, Township of Milton, County of Rock, State of Wisconsin, excepting therefrom:

A.

All that certain piece or parcel of land, lying and being in the Town of Milton in the County of Rock and State of Wisconsin, known and distinguished as follows, to-wit: Beginning at the quarter post standing in the south line of section 34, town four north, range 13 east; thence west along said section line eight chains and 95 links to the center of the highway leading to Janesville; thence northeasterly along the center of said highway 40 chains and 58 links to the quarter line of said section 34; thence east along said quarter line three chains and 37 links to a post; thence south parallel with the east line of said section to the south line of section 34; thence west along said south line to the place of beginning.

B.

All that certain piece or parcel of land, lying and being in the Town of Milton in the County of Rock and State of Wisconsin, known and distinguished as follows, to-wit: Beginning at the quarter post standing at the northeast corner of the southeast quarter (SE one-fourth) of section 34 in township four north, range 13 east; thence west along the quarter line of said section number 34 12 chains and 50 links; thence south parallel with the east line of said section 34 to the south line of said section 34; thence east along said south line to the southeast corner of the southeast quarter (SE one-fourth) of said section 34; thence north along the east line of said section 34 to the place of beginning.

C.

Land conveyed for highway purposes by deed recorded August 11, 1959, in Volume 541 of Deeds, Page 20, Document Number 613233.

Parcel 2: Lot 2 of Certified Survey Map recorded in Volume 8 of Certified Survey Maps on pages 497 and 498 as Document Number 912655 and being a part of the E one-half of the SE one-fourth of section 34, township 4 north, range 13 east of the fourth Principal Meridian, Milton Township, Rock County, Wisconsin.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification.

A.

The following described area of territory annexed to the City of Milton by this ordinance shall be zoned R-3:

Part of the SE. one-fourth of section 34, T.4N., R.13E. of the fourth P.M., City of Milton, Rock County, Wisconsin.

Described as follows: Beginning at the NW. corner of Lot 2 of a Certified Survey Map as recorded in Volume 8, Pages 497 and 498; thence southwesterly 490 feet, more or less to the centerline of a gas main; thence southwesterly along said centerline 190 feet, more or less; thence westerly 185 feet, more or less to the centerline of proposed Arthur Drive; thence southerly along said centerline, 120 feet, more or less; thence westerly 485 feet, more or less to the petitioner's west line; thence northerly along said west line, 1,410 feet, more or less to the south line of Out Lot 95 of the Assessor's Plat; thence easterly along said south line, 985 feet, more or less to the east line of the petitioner's property; thence southerly along said east line, 660 feet, more or less to the place of beginning.

B.

The following described area of territory annexed to the City of Milton by this ordinance shall be zoned B-2:

Part of the SE. one-fourth of section 34, T.4N., R.13E., of the fourth P.M., City of Milton, Rock County, Wisconsin, including Lot Two of a Certified Survey Map as recorded in Volume 8, Pages 497 and 498.

Described as follows: Beginning in the NW. corner of said Lot Two; thence easterly to the NE. corner of said Lot Two; thence southwesterly along the northwesterly right-of-way line to the west line of the petitioner's property; thence northerly along said west line, 965 feet, more or less to the south line of the petitioner's proposed R-3 zoning; thence easterly 485 feet, more or less to the centerline of proposed Arthur Drive; thence northerly along said centerline 120 feet, more or less; thence easterly 185 feet, more or less to the centerline of gas main; thence northeasterly along said centerline 190 feet, more or less; thence northeasterly 490 feet, more or less to the place of beginning.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the third ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

This ordinance shall take effect and be in force from and after its passage and publication.
