Article XXVII. VIGNEAULT/CALL ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021(12), the following described territory in the Town of Milton, Rock County, Wisconsin, owned by Robert and Teresa Vigneault and Steven and Catherine Call and lying contiguous to the present city boundary is hereby annexed to the City of Milton, Rock County, Wisconsin:

All of the following described property:

Commencing at an aluminum monument at the NW corner of said section 28; thence S. 0 degrees 39 minutes 55 seconds E. along the west line of the NW one-fourth of said section, 798.39 feet to the northerly R.O.W. (right-of-way) line of C.T.H. M; thence S. 85 degrees 14 minutes E. along said northerly R.O.W. line, 850.76 feet to the place of beginning for the land to be herein described:

Thence N. 0 degrees 48 minutes E. 312.26 feet to the north line of said Lot 1; thence S. 88 degrees 40 minutes E. along said north line, 137.22 feet to the NE corner of said Lot 1; thence S. 0 degrees 48 minutes W. 324.55 feet to the SE corner of said Lot 1; thence westerly along said northerly R.O.W. line, along a curve convexed northerly, 109.39 feet, having a radius of 1,484.0 feet and a chord bearing N.83 degrees 07 minutes W. 109.35 feet; thence N. 85 degrees 14 minutes W. continuing along the northerly R.O.W. line, 28.54 feet to the place of beginning.

Containing a total of approximately 1.0 acre, more or less.

Effect of annexation. From and after the date of this ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance shall be zoned R-1.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the eighth ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

(5)

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

Effective date. This ordinance shall take effect and be in force from and after its passage and publication.
