Article XXXIV. SCHULTZ PROPERTY ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021, and the petition for annexation of owned property filed with the city clerk of the City of Milton on the ninth of December, 2002, with three electors residing in the territory, and Beverly, David and Joan Schultz being the sole owners of all land in this territory, the following described territory in the Town of Milton, Rock County, Wisconsin, shall be annexed to the City of Milton, to-wit:

Part of the NE one-fourth of the NW one-fourth, part of the SE one-fourth of the NW one-fourth, part of the NW one-fourth of the NE one-fourth, part of the NE one-fourth of the NE one-fourth, part of the SE one-fourth of the NE one-fourth and part of the SW one-fourth of the NE one-fourth of section 35, town 4 north, range 13 east, Town of Milton, Rock County, Wisconsin described as follows:

Commencing at the east one-fourth corner of section 35 thence west along the south line of the NE one-fourth to the southwest corner of the east one-half of the east one-half of the east one-half of the NE one-fourth of section 35; thence north along the west line of said east one-half of the east one-half of the NE one-fourth of section 35 and its extension thereof to the north right-of-way line of Highway 59; thence west along said right-of-way line to the east line of Certified Survey Map recorded in Volume 4 Page 230; thence south and west along the perimeter of said Certified Survey Map to the southwest corner thereof; thence south along the east line of lands described in Volume 403 of Records Page 132 to the centerline of C.T.H. M; thence southeast along said centerline to the south line of the NE of section 35; thence east to the point of beginning.

Excepting a parcel of land containing approximately 1.25 acres currently owned by Ronald Struzynski and Lizabeth Thatcher as described in Volume 200 of Records, Page 966; and also excepting a parcel of land containing approximately 12.3 acres currently owned by John Kath as described in Volume 841 of Records Page 679.

Effective date of annexation. From and after the date of this ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons currently residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designed to be zoned M-2 for zoning purposes and shall be designated such on the city zoning map.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of ward 3 of the City of Milton.

Effective date of annexation. This ordinance shall take effect upon its passage and publication as provided by law.
