Article XXXVII. REGAL PROPERTIES, LLC/MIRKWOOD DEVELOPMENT ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.0217(2), and the petition for annexation of owned property filed with the city clerk of the City of Milton on the 23rd day of May 2003, with no electors residing in the territory, Regal Properties, LLC and Mirkwood Development, owner of all of the land in this territory, the following described territory in the Town of Milton, Rock County, Wisconsin, shall be annexed to the City of Milton, to-wit:

Parcel 1: Part of the NE quarter of section 28, T.4N., R.13E. of the fourth P.M., Town of Milton, Rock County, Wisconsin.

Described as follows: Commencing at an aluminum monument at the north quarter corner of said section; thence S. 87 degrees 53' 35" E. along the north line of said NE. quarter of said section, 1,468.49 feet to a point on the east line of Northridge, a recorded subdivision; thence S. 21 degrees 05' W. along said east line, 180.72 feet to an iron pin monument at the NW. corner of Lot 16 of said Northridge, also being at the place of beginning for the land to be herein described; thence S. 88 degrees 90' 20" E. along the easterly extension of the north line of said Lot 16, 50.0 feet to an iron pin monument; thence S. 21 degrees 05' W. parallel with said east line, 260.32 feet to an iron pin monument on the north R.O.W. (right-of-way) line of Sunset Drive; thence N. 88 degrees 02' 35" W. along said R.O.W. line, 50.0 feet to the SE. corner of said Lot 16 now occupied by a tree; thence N. 21 degrees 05' E. along said east line, 260.23 feet to the place of beginning.

Parcel 2: Part of the NE. quarter of section 28, T.4N., R.13E. of the fourth P.M., Town of Milton, Rock County, Wisconsin.

Described as follows: Commencing at an aluminum monument at the north quarter corner of said section; thence S. 87 degrees 53' 35" east along the north line of said NE. quarter of said section, 1,468.49 feet to a point on the East line of Northridge, a recorded subdivision; thence S. 21 degrees 05' W. along said east line, 525.62 feet to an iron pin monument on the south R.O.W. (right-of-way) line of Sunset Drive; also being at the place of beginning for the land to be herein described; thence S. 88 degrees 02' 35" east along said south R.O.W. line, 50.0 feet to an iron pin monument; thence S. 21 degrees 05' W. parallel with the east line of Lot 33 of said Northridge, 97.38 feet to a point; thence N. 88 degrees 02' 35" W., 50.0 feet to a point on the east line of said Lot 33; thence N. 21 degrees 05' E. along the east line of said Lot, 97.38 feet to the place of beginning.

Effective date of annexation. From and after the date of this ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons currently residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily designed to be zoned R-3, Residential District 3, for zoning purposes and shall be designated such on the city zoning map.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of ward 8 of the City of Milton.

(5)

Effective date of annexation. This ordinance shall take effect upon its passage and publication as provided by law.
