Article XXXVIII. SCHULTZ AND HULL FARMS, INC. PROPERTY ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021, and the petitions for annexation of owned property filed with the city clerk of the City of Milton, with no electors residing in the territories, and Beverly Schultz and David and Joan Schultz and Hull Farms, Inc., being the sole owners of all land in this territory, the following described territory in the Town of Milton, Rock County, Wisconsin, shall be annexed to the City of Milton, to-wit:

Part of the SE quarter of the SE quarter, part of the SW quarter of the SE quarter of section 26, part of the NE quarter of the NW quarter, part of the SE quarter of the NW quarter, part of the NW quarter of the NE quarter, part of the NE quarter of the NE quarter, part of the SE quarter of the NE quarter and part of the SW quarter of the NE quarter of section 35, Town 4 North, Range 13 East, Town of Milton, Rock County, Wisconsin, described as follows:

Commencing at the east quarter corner of section 35 thence west along the south line of the NE quarter to the southwest corner of the east half of the east half of the east half of the NE quarter of section 35, the point of beginning. Thence north along the west line of said east half of the east half of the east half of the NE quarter of section 35 and its extension thereof to the north right of way line of Highway 59; thence east along said north right of way line to the east line of section 26; thence north along the east line of section 26 to the south right of way line of lands owned by the Wisconsin Department of Transportation (formerly Central Wisconsin Railroad); thence west along said right of way line to the east right of way line of Hoover Boulevard as depicted on the plat of Summerdale, also being the east line of a 66 foot wide strip of land described in Volume 499 of Records, Page 939; thence along said 66 foot wide strip of land for the following 3 courses: south to the north right of way line of Highway 59; west along said north right of way line to the west line of said 66 foot wide strip of land; north to northeast corner of lot 1 Certified Survey Map recorded in Volume 21 Page 19; thence northwest to the northwest corner of said lot 1; thence south on the west line of said Certified Survey Map and it's extension thereof to the south right of way line of Highway 59; thence west along said right of way line to the east line of Certified Survey Map recorded in Volume 4 Page 230; thence south and west along the perimeter of said Certified Survey Map to the southwest corner thereof; thence south along the east line of lands described in Volume 403 of Records Page 132 to the centerline of C.T.H. M; thence southeast along said centerline to the south line of the NE quarter of section 35; thence east to the point of beginning.

Excepting a parcel of land containing approximately 1.25 acres currently owned by Ronald Struzynski and Lizabeth Thatcher as described in Volume 200 of Records, Page 966; and also excepting a parcel of land containing approximately 12.3 acres currently owned by John Kath as described in Volume 841 of Records, Page 679.

Amendment of prior annexation. The above-described parcel constitutes an amendment to Milton Ordinance #170 adopted on January 21, 2003 and recorded as Document No. 1593452 with the Rock County Register of Deeds on March 4, 2003, due to a scrivener's error in said Ordinance. The above-described parcel also constitutes an amendment to Milton Ordinance #171 adopted on January 21, 2003, and recorded as Document No. 1593451 with the Rock County Register of Deeds on March 4, 2003, due to a scrivener's error in said ordinance.

Effective date of annexation. From and after the date of this ordinance, the territory in subsection (1) shall be part of the City of Milton for any and all purposes provided by law and all persons currently residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be zoned M-2 for zoning purposes and shall be designated as such on the city zoning map.

(5)

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of ward 3 of the City of Milton.

(6)

Effective date of annexation. This ordinance shall take effect upon its passage and publication as provided by law.
