Article XXXXII. HETH FAMILY TRUST ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.0217(2), and the petition for annexation of owned property filed with the city clerk of the City of Milton on the 23rd day of December, 2013, with no electors residing in the territory, James R. Heth, and The Dwayne A. and Jean M. Heth Family Trust Dated January 1, 2010, being owners of all the land in this territory, the following described land in the Town of Milton, Rock County, Wisconsin shall be annexed to the City of Milton, to-wit:

Part of the NW one-fourth of Section 35, T.4N., R.13E. of the fourth P.M., Town of Milton, Rock County, Wisconsin.

Described as follows: Commencing at the north one-fourth corner of said section; thence S.0°36′56″E. along the north-south centerline of said section, 1940.71 feet to the centerline of Chicago Street, also being at the place of beginning for the land to be herein described; thence S.0°36′56″E. continuing along said north-south centerline, 50.04 feet to the SW line of Chicago Street; thence N. 41°52′46″W. along said SW line, 208.51 feet; thence northwesterly continuing along said SW line and along the south line of Commerce Way, along a curve to the left, 359.37 feet, having a radius of 467.00 feet and a chord bearing N.68°39′27″W. 350.57 feet; thence S.89°17′49″W. continuing along said South Line, 940.34 feet to the west line of Sunnyside Drive; thence N.0°42′10″W. along said west line, 594.21 feet; thence N.0°45′51″W. continuing along said west line, 772.93 feet to the centerline of Chicago Street; thence S.41°51′33″E. along said centerline, (portions of this road have been vacated) 2132.54 feet to the place of beginning.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily assigned the Large Scale Commercial (B-2) zoning district classification and shall be designated such on the city zoning map.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of Ward 10 of the City of Milton.

Future taxation. After annexation is effective, the property described in subsection (1) shall be exempt from further taxation in the Town of Milton and henceforth shall be subject to taxation and assessments as part of the City of Milton.

Tax reimbursement. Pursuant to Wis. Stats. § 66.0217(14)(a), the city of Milton agrees to pay annually to the Town of Milton for five years an amount equal to the amount of the property taxes levied by the Town of Milton on the annexed territory, as shown by the tax roll, in the year in which the annexation is final.

Effect on school district. The annexed territory, being currently a part of the school district of Milton, will have no effect on the size or shape of said school district.

Effective date of annexation. This ordinance shall take effect upon enactment.
