(1) Territory annexed. In accordance with Wis. Stats. § 66.0217(2), and the petition for annexation of owned property filed with the city clerk of the City of Milton on the 30th day of May, 2013, with no electors residing in the territory, Hull Farms, Inc. being owner of all the land in this territory, the following described in the Town of Milton, Rock County, Wisconsin shall be annexed to the City of Milton, to-wit: Part of these one-fourth of section 26, part of the NE one-fourth of section 35 and part of the NW one-fourth of section 36, all in T.4N., R.l3E. of the fourth P.M., Town of Milton, Rock County, Wisconsin. Described as follows: Beginning at the NW corner of said section 36; thence S.0°18'39"E. along the west line of the NW one-fourth of said section, 36.71 feet to the south line of East High Street; thence S.88°58'06"E. along said south line, 61.03 feet; thence N.89°30'55"E. continuing along said south line, 199.79 feet; thence S.88°44'11"E. continuing along said south line, 81.12 feet to the NW corner of Lot 1 of a Certified Survey Map recorded in Volume 11, Pages 563 thru 564 as Document No. 993584; thence S.0°18'43"E. 672.79 feet to the SW corner of said Lot; thence S.88°27'54"W. along a line of a Certified Survey Map recorded in Volume 8, Page 299, as Document No. 904724, a distance of 612.87 feet; thence N.0°31'41"W. along a line of said Certified Survey Map, 695.34 feet to said south line of East High Street; thence N.88°58'06"W. along said south line, 30.01 feet to the west line of said Certified Survey Map; thence S.0°31'41"E. along said west line, 1,058.78 feet to the SW corner of said Certified Survey Map; thence S.89°0l'35"E. 962.81 feet to the SE corner of said Certified Survey Map; thence S.8°55'53"W. 541.22 feet to the point of intersection of the south line of State Highway "59" and the west line of County Trunk Highway "M"; thence S.1°41'01"E. along said west line, 150.28 feet; thence S.0°38'27"W. continuing along said west line, 499.93 feet; thence S.0°21'35"W. continuing along said west line, 274.79 feet to the north line of Putman Parkway; thence N.89°11'52"W. along said north line, 561.32 feet; thence N.88°12'09"W. continuing along said north line, 283.78 feet; thence northwesterly continuing along said north line, along a curve to the right, 50.50 feet, having a radius of 260.00 feet and a chord bearing N.82°38'19"W. 50.42 feet to the east line of Lot 1 of a Certified Survey Map recorded in Volume 33, Pages 295 thru 298, as Document No. 1886983; thence N.0°20'50"W. along said east line, 1218.80 feet to the NE corner of said Lot 1; thence N.0°21'16"W. 234.52 feet to the north line of State Highway "59"; thence N.0°20'33"W. along the east line of Lot 1 of a Certified Survey Map recorded in Volume 31, Pages 122 thru 126 of Certified Survey Maps as Document No. 1791166 and its southerly and northerly extensions, 1,147.23 feet to the north line of East High Street; thence S.88°17'19"E. along said north line, 296.15 feet; thence S.89°00'19"E. continuing along said north line, 36.59 feet to the east line of the SE one-fourth of said section 26; thence S.0°42'59"E. along said east line, 48.42 feet to the place of beginning. (2) Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily assigned the General Industrial (M-2) zoning district classification and shall be designated such on the city zoning map. (3) Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of Ward 9 of the City of Milton. (4) Future taxation. After annexation is effective, the property described in subsection (1) shall be exempt from further taxation in the Town of Milton and henceforth shall be subject to taxation and assessments as part of the City of Milton. (5) Tax reimbursement. Pursuant to Wis. Stats. § 66.0217(14)(a), the City of Milton agrees to pay annually to the Town of Milton for five years an amount equal to the amount of the property taxes levied by the Town of Milton on the annexed territory, as shown by the tax roll, in the year in which the annexation is final. (6) Effect on school district. The annexed territory, being currently a part of the school district of Milton, will have no effect on the size or shape of said school district. (7) Effective date of annexation. This ordinance shall take effect upon enactment. |
