Article XXXX. BELARDI FAMILY INVESTMENTS, LLC ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.0217(2), and the petition for annexation of owned property filed with the city clerk of the City of Milton on the 16th day of July, 2013, with no electors residing in the territory, Belardi Family Investments, LLC being owner of all the land in this territory, the following described in the Town of Milton, Rock County, Wisconsin shall be annexed to the City of Milton, to-wit:

Part of the SW one-fourth and part of the NW one-fourth of section 36, T.4N., R.l3E. of the fourth P.M., Town of Milton, Rock County, Wisconsin.

Described as follows: Beginning at the south one-fourth corner of said section; thence N.89°00'14"W. along the south line of the SW one-fourth of said section, 1320.29 feet to the west line of the SE one-fourth of the SW one-fourth of said section; thence N.0°48'55"W. along said west line, 1331.46 feet to the south line of the NW one-fourth of the SW one-fourth of said section; thence N.89°06'04"W. along said south line, 1325.29 feet to the west line of the SW one-fourth of said section; thence N.1°02'01"W. along said west line, 1329.38 feet to the west one-fourth corner of said section; thence S.89°11'52"E. along the east-west centerline of said section, 561.24 feet to the west line of County Trunk Highway "M"; thence N.1°21'35"E. along said west line, 354.79 feet; thence N.0°38'27"E. continuing along said west line, 499.93 feet; thence N.1°41'01"W. continuing along said west line, 150.28 feet to the south line of State Highway "59"; thence N.8°55'53"E. 541.22 feet to the SE corner of Lot 1 of a Certified Survey Map recorded in Volume 8, Page 299 as Document No. 904724; thence N.0°49'05"W. along the east line of said Lot, 404.21 feet to the south line of Lot 1 of a Certified Survey Map as recorded in Volume 11, Pages 563—564 as Document No. 993584; thence N.88°27'54"E. along said south line, 2.30 feet to the SE corner of said Lot 1; thence N.0°17'54"W. 656.88 feet to the NE corner of said lot; thence S.88°12'24"E. along the south line of East High Street, 199.02 feet; thence S.57°57'22"E. continuing along said south line, 58.37 feet; thence S.89°09'44"E. continuing along said south line, 99.81 feet; thence N.69°32'58"E. continuing along said south line, 53.67 feet; thence S.88°58'53"E. continuing along said south line, 263.30 feet to the east line of the West one-half of the NW one-fourth of said section; thence S.0°27'15"E. along said east line, 2586.83 feet to said east-west centerline; thence S.89°11'52"E. along said east-west centerline, 1330.30 feet to the center of said section; thence S.0°35'52"E. along the north-south centerline of said section, 2667.11 feet to the place of beginning.

Temporary zoning classification. The territory annexed to the City of Milton by this ordinance is temporarily assigned the General Industrial (M-2) zoning district classification and shall be designated such on the city zoning map.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of Ward 9 of the City of Milton.

(4)

Future taxation. After annexation is effective, the property described in subsection (1) shall be exempt from further taxation in the Town of Milton and henceforth shall be subject to taxation and assessments as part of the City of Milton.

Tax reimbursement. Pursuant to Wis. Stats. § 66.0217(14)(a), the City of Milton agrees to pay annually to the Town of Milton for five years an amount equal to the amount of the property taxes levied by the Town of Milton on the annexed territory, as shown by the tax roll, in the year in which the annexation is final.

Effect on school district. The annexed territory, being currently a part of the school district of Milton, will have no effect on the size or shape of said school district.

(7)

Effective date of annexation. This ordinance shall take effect upon enactment.
