Article XXIII. CITY-OWNED PROPERTY ANNEXATION - BENTZ PROPERTY  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.025, the following described territory in the Town of Milton, Rock County, Wisconsin, owned by the City of Milton and lying contiguous to the present city boundary:

Part of the SW. one-fourth and SE. one-fourth of section 34, T.4N., R.13E. of the fourth P.M., Milton Township, Rock County, Wisconsin.

Described as follows: Beginning at the south one-fourth corner of said section 34; thence S. 89 degrees 48 minutes W. along the south line of the SW. one-fourth of said section, 597.33 feet to the centerline of Parkview Drive; thence N. 21 degrees 55 minutes 50 seconds E. along said centerline, 2,201.28 feet to the south line of Brown Heights; thence N. 89 degrees 53 minutes 20 seconds E. along said south line, 498.03 feet to the SE corner of Lot 4 of said Brown Heights; thence S. 2 degrees 56 minutes 30 seconds E. 1,765.08 feet to the northwesterly R.O.W. (right-of-way) line of S.T.H. 26; thence S. 49 degrees 40 minutes 30 seconds W. along said R.O.W. line, 372.45 feet; thence S. 83 degrees 48 minutes 30 seconds W. continuing along said R.O.W. line, 334.19 feet; thence S. 89 degrees 58 minutes 20 seconds W. continuing along said R.O.W. line, 115.84 feet to the north one-fourth corner of section 3-3-13; thence S. 89 degrees 18 minutes 30 seconds W. 81.44 feet to the place of beginning. Containing 43.82 acres.

Effect of annexation. From and after the date of this ordinance the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification. The territory annexed to the City of Milton by this ordinance is designated to be part of the agricultural district two (A-2) of the City of Milton for zoning purposes and subject to all provisions of "Chapter 9 Zoning Ordinance" relating to such district classifications and zoning in the City of Milton.

Ward designation. The territory described in subsection (1) of this ordinance is hereby made a part of the third ward of the City of Milton subject to the ordinances, rules and regulations of the city governing wards.

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

Effective date. This ordinance shall take effect upon passage and publication as provided by law.
