Article XXIV. LUKAS (MIRKWOOD DEVELOPMENT) ANNEXATION  


(1)

Territory annexed. In accordance with Wis. Stats. § 66.021(12), the following described territory in the Town of Milton, Rock County, Wisconsin, owned by the Henry Lukas and lying contiguous to the present city boundary is hereby annexed to the City of Milton, Rock County, Wisconsin:

All of the following described property:

That part of the southeast quarter (SE one-fourth) of section 21, township four north, range 13 east which is bounded on the west by the Clear Lake Road; on the south by the south line of said southeast quarter (SE one-fourth); on the east by the Chicago and northwestern Railroad, and on the north by a line far enough north of said south line to include six acres of land; all in the Township of Milton, Rock County, Wisconsin. Excepting that part conveyed to the state highway commission by award of damages, dated March 20, 1967, and recorded in the office of the Register of Deeds for Rock County, Wisconsin, on October 26, 1967, in Volume 264 of Records on page 540 as Document No. 722789.

Also, all that part of the northeast quarter (NE one-fourth) of said section 28, which lies west of the Chicago and Northwestern Railroad and north of Chambers Addition to the Village of West Milton (Milton Junction), now being known and described as Out Lot Number 113 of said Assessor's Plat to the Township of Milton, in Rock County, Wisconsin;

Also, Chambers Addition to the Village of West Milton (Milton Junction), in the Township of Milton, Rock County, Wisconsin, comprising two blocks;

Excepting that portion of the above described property contained in Lots 1, 2, and 3 of Certified Survey Map recorded in the Rock County Register of Deeds July 29, 1987, in Volume 13 of Certified Survey Map of Rock County at pages 23, 24, and 25, as Document #1056349.

Containing a total of approximately 22.5 acres, more or less.

Effect of annexation. From and after the date of this Ordinance, the territory described in subsection (1) shall be a part of the City of Milton for any and all purposes provided by law and all persons coming or residing within such territory shall be subject to all ordinances, rules and regulations governing the City of Milton.

Zoning classification.

A.

The following described area of territory annexed to the City of Milton by this Ordinance shall be zoned R-3:

The northerly 360 feet of the following described property:

Also, Chambers Addition to the Village of West Milton (Milton Junction), in the Township of Milton, Rock County, Wisconsin, comprising two blocks;

Excepting that portion of the above described property contained in Lots 1, 2, and 3 of Certified Survey Map recorded in the Rock County Register of Deeds July 29, 1987, in Volume 13 of Certified Survey Map of Rock County at pages 23, 24, and 25, as Document #1056349.

B.

The following described area of territory annexed to the City of Milton by this Ordinance shall be zoned R-4:

All of the following described property except: The northerly 360 feet thereof.

That part of the SE one-fourth of section 21, township four north, range 13 east which is bounded on the west by the Clear Lake Road; on the south by the south line of SE one-fourth; on the east by the Chicago and Northwestern Railroad, and on the north by a line far enough north of said south line to include six acres of land; all in the Township of Milton, Rock County, Wisconsin. Excepting that part conveyed to the state highway commission by award of damages, dated March 20, 1967, and recorded in the office of the Register of Deeds for Rock County, Wisconsin, on October 26, 1967, in Volume 264 of Records on page 540 as Document No. 722789.

Also, all that part of the NE one-fourth of said section 28, which lies west of the Chicago and Northwestern Railroad and north of Chambers Addition to the Village of West Milton (Milton Junction), now being known and described as Out Lot Number 113 of said Assessor's Plat to the Township of Milton, in Rock County, Wisconsin;

Also, Chambers Addition to the Village of West Milton (Milton Junction), in the Township of Milton, Rock County, Wisconsin, comprising two blocks;

Excepting that portion of the above described property contained in Lots 1, 2, and 3 of Certified Survey Map recorded in the Rock County Register of Deeds July 29, 1987, in Volume 13 of Certified Survey Map of Rock County at pages 23, 24, and 25, as Document #1056349.

Ward designation. The territory described in subsection (1) of this Ordinance is hereby made a part of the eighth ward of the City of Milton, subject to the ordinances, rules and regulations of the city governing wards.

(5)

Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application.

(6)

Effective date. This ordinance shall take effect and be in force from and after its passage and publication.
